Liberty Protection Safeguards (LPS) Implementation


In July 2018, the Government published a Mental Capacity Bill, which was passed into law in May 2019. It replaces the Deprivation of Liberty Safeguards (DoLS) with a scheme known as Liberty Protection Safeguards (LPS).

Helen Whately MP, Minister of State (Minister for Care) made a statement about the implementation timetable for LPS, which can be found in the latest Department of Health and Social Care LPS newsletter.

It is now clear that successful implementation is not possible by October 2020, and now aim for full implementation of LPS by April 2022. The Government will undertake a public consultation on the draft regulations and Code of Practice for LPS. That will run for 12 weeks, allowing sufficient time for those that are affected, including those with learning disabilities, to engage properly.
